DECISION (REDUNDANCY PAY)

 

The claim of the claimant William Stewart in respect of redundancy pay is well founded and it is ordered that the respondent should pay to the claimant the sum of £2,450 in respect of redundancy pay.

The claimant was represented by Jill Downing Solicitor of Magennis & Creighton.

The respondent was not represented.

 

 

REASONS

 

1.              The respondent company is in severe financial difficulties, but has not gone into liquidation or administration.  The respondent has not presented a response in these proceedings.

 

2.              The claimant has made claims in respect of redundancy pay and in respect of other employment debts.  This decision deals only with the redundancy claims.  (A separate decision will be issued in due course in relation to the claims in respect of the “other debts”).

3.              During the course of this hearing, I issued my decision in respect of redundancy payments orally.  At the same time, I gave my reasons orally.

 

 

Facts

 

4.              The claimant was dismissed from 3 March 2009.  I was satisfied that the claimant gave evidence which was true to the best of his relevant current knowledge, information and belief. On the basis of that evidence, I identified the claimant’s age, length of service and gross weekly pay.  Details in relation to those matters are set out below:-

Length of service:              10 Years

 

Gross weekly pay:             £350
