THE INDUSTRIAL TRIBUNALS
CASE REF: 6896/09
CLAIMANT: Wendy Mc Farlane
RESPONDENT: Financial Foresight
James Smyth t/a Ballygowan Agencies
James Smyth t/a Financial Foresight
Financial Foresight (NI) Limited
DECISION ON REVIEW
This decision of the Tribunal is that the amount awarded to the claimant be amended from £6,819.80 to £7,059.80
Constitution of Tribunal:
Chairman: Ms P Sheils
Panel Members: Mr B Irwin
Mr D Walls
The Tribunal on its own motion directed on 23 June 2010 that, under the Industrial Tribunals (Constitution and Rules of Procedure) Regulations 2005, Rule 34, the parties be advised that the Tribunal intended to review its decision in this case issued on 8 June 2010
The Tribunal advised the parties that on re-reading its decision the Tribunal had noticed that it had failed to award the claimant her proper entitlement under the basic award. At paragraph 47 of the decision the Tribunal notes that the claimant had four years employment service with the respondent but calculated her basic award using a multiplier of 3 years instead of 4 years.
There was no objection received by any of the parties to this review.
On this review the Tribunal hereby amends this position and makes the proper calculation to be as follows:
Basic Award £240, gross weekly pay x 4 years =£960
Accordingly the Tribunal amends the claimant’s total award from £6,819.80 to £7,059.80
