DECISION

The decision of the tribunal is that the respondent do pay to the claimant:-

 

          (i)       the sum of £1,597.85 in respect of unlawful deductions from his wages; and

 

          (ii)      the sum of £409.52 in respect of breach of contract (notice pay).

Appearances:

The claimant appeared in person and was not represented.

The respondent did not appear and was not represented.

 

1.       The claimant’s claims for unlawful deductions from wages and breach of contract were undefended.  Notice of Hearing was sent to the respondent on 20 September 2010.  It has not been returned to the Office of the Tribunals.

 

2.       The claimant worked for the respondent from 21 September 2009 until 21 January 2010 as a web designer.  He was dismissed from his employment without notice on that date.  No reason was given for his dismissal.

 

3(i)     I am satisfied from the evidence of the claimant that at the time of his dismissal, unpaid wages of £1,597.85 (net) were outstanding.

 

 (ii)     I am further satisfied that he did not receive the one week’s notice pay,          £409.52 (net), to which he was entitled.

 

 (iii)     I therefore order that the respondent do pay to him each of the above amounts.

 

4.       This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
