DECISION ON APPLICATION FOR A REVIEW
1. The review application has been considered by the President as it was not reasonably practicable for the original tribunal to consider it.
2. The time limit for the review application to be made is extended to 11 March 2010 in the interests of justice.
3. The review application made by the respondent and consented to by the claimant is granted. The decision of the tribunal in respect of compensation, set out at paragraph 29.8 of the decision, issued on 4 December 2009, is varied to read that the tribunal has determined that it is just and equitable to order that the respondent pays the claimant £20 per hour for each hour that the claimant was entitled to a rest period on each of the occasions which are the subject of his claim and in this particular claim the sum agreed between the parties is £440.
