The decision of the tribunal is that the claimant is entitled to redundancy pay in the sum of £759.68, notice pay in the sum of £1,139.52, holiday pay in the sum of £227.90 and unpaid wages in the sum of £75.97.
Constitution of Tribunal:
Chairman (sitting alone): Mr P Kinney
Appearances:
The claimant appeared in person and represented herself.
The respondents did not appear and were not represented.
1. The claimant was employed by the respondents until her dismissal on 28 June 2011. The claimant’s age at the age of dismissal was 24 and she had six years’ continuous service at the date of dismissal. At the date of dismissal the claimant’s gross weekly wage was £189.92. Her net weekly wage was the same.
2. The claimant’s employment terminated on 28 June 2011 when the respondents phoned her to say the business was closed. The claimant had not received redundancy pay, nor did she receive any notice pay. She was entitled to six days’ holiday and had not received wages for her last two days of work.
3. I am satisfied that the claimant’s claims are well-founded and I award the claimant the sum of £759.68 redundancy pay. The claimant is also entitled to six weeks’ notice pay based on her net weekly sum in the sum of £1,139.52. The claimant is entitled to six days’ holiday pay in the sum of £227.90 and two days’ pay in the sum of £75.97.
