THE INDUSTRIAL TRIBUNALS

CASE REF: 5639/17

CLAIMANT: Patrick Berwick

RESPONDENT: Phillip Greer, t/a PG Joinery

DECISION

The decision of the tribunal is that the respondent is ordered to pay to the claimant a redundancy payment of £560.00 and further the respondent is ordered to pay to the claimant £640.00 for his failure to provide to the claimant in writing his main terms and conditions of employment.

Constitution of Tribunal:

Employment Judge (sitting alone): Employment Judge Greene

Appearances:

The claimant appeared in person.

The respondent was represented by Mr Phillip Greer.

1. The claimant brought a claim for a redundancy payment.

2. In his response the respondent indicated that it did not intend to resist the claim.

3. By consent the title of the respondent was amended to that which appears above.

4. On 9 November 2017 I issued a Default Judgement in favour of the claimant in relation to liability only.

5. The claim came on for hearing on today in relation to remedy.

6. On the basis of the evidence before me I am satisfied that the claimant is entitled to a redundancy payment of £560.00 and I order the respondent to make that payment to him.

7. It emerged in the course of the evidence that the claimant had not been provided with his main terms and conditions of employment in writing. Accordingly I award to the claimant £640.00 by reason of the respondent's failure to provide the main terms and conditions of employment in writing.

8. Reasons for my decision were given at the hearing.

9. This is a relevant decision for the purposes of the Industrial Tribunals (Interest) Order (Northern Ireland) 1990.
