The tribunal allows the amendment to the claimant’s claim form by adding the further information set out in the submission of 10 February 2019.

APPEARANCES:

 

The claimant appeared in person accompanied by a McKenzie friend Mr Martin Cullen.

 

The respondent was represented by Mr B Mulqueen, of counsel, instructed by Arthur Cox Solicitors.

 

 

1.         The claimant applied on 10 February 2019 to amend his claim by adding a claim for whistleblowing and factual information in support of that claim.

 

2.         The wording for the proposed amendment was set out in his submission of 10 February 2019.  A pre-hearing review was directed to be convened on today to consider the claimant’s application to amend his claim.

 

3.         The respondent opposed the claimant being granted leave to amend his claim.

 

4.         The application to amend was dealt with by submissions by both parties and by reference to an agreed bundle of documents that was prepared for the tribunal and by answers provided to questions posed by the tribunal.

 

5.         Having considered the application to amend the claim I allowed the amendment.

 

6.         Oral reasons for my decision were given at the hearing. 

 

7.         The respondent will have until 29 March 2019 to amend their response form.

 

8.         The parties agreed that a Case Management Discussion would be convened immediately to deal with the timetabling of this claim to hearing.
