GREY SEALS PROTECTION ACT (NORTHERN IRELAND) 1933 GREY SEALS PROTECTION ACT (NORTHERN IRELAND) 1933 - LONG TITLE An Act to make further provision as respects Northern Ireland for the protection of the Grey Seal. [9th May 1933] Close season for grey seals. GREY SEALS PROTECTION ACT (NORTHERN IRELAND) 1933 - SECT 1 1.(1) Subject as hereinafter provided, there shall be an annual close season for grey seals, that is to say, seals of the species known as Halichoerus grypus, extending from the first day of September to the thirty-first day of December, both inclusive: Provided that the Ministry of Commerce may at any time by order direct, either generally or as respects any area described in the order, that, notwithstanding anything in the foregoing provision (a)there shall be no close season during the twelve months next following the making of the order; or (b)the next close season shall commence and end on such dates as may be specified in the order. (2) An order made under this section which renders lawful the killing of grey seals during any part of the period specified in sub-section (1) shall contain regulations providing for the grant and revocation of permits by the Ministry and prohibiting such killing except (a)by persons holding permits; and (b)in such manner and by means of such weapon or instrument as may be specified in the regulations. (3) Before any order is made under this section the draft thereof shall be laid before each House of Parliament for the statutory period, and if a resolution disapproving the draft or any part thereof is passed by either House of Parliament within the statutory period, no further proceedings shall be taken on the draft, but if no such resolution is passed, the Ministry may at the expiration of the said period make an order in the terms of the draft. For the purposes of this section the expression "statutory period" means ... definition in 1954 c.33 (NI) s.41(2) substituted by 1979 NI12 art.10 GREY SEALS PROTECTION ACT (NORTHERN IRELAND) 1933 - SECT 2 Offences in relation to grey seals during close season. 2.(1) Every person who (a)during the close season knowingly and with intent kills, wounds or takes a grey seal; or (b)being an owner, master, charterer or hirer of a boat uses, or permits any person to use, it for the purpose of killing, wounding or taking a grey seal during the close season; or (c)contravenes any such regulation as is mentioned in sub-section (2) of the preceding section; (i)in the case of offences under paragraph (a) of this sub-section, to a fine not exceeding [#20] in respect of each such offence; and (ii)in the case of offences under paragraph (b) or paragraph (c) of this sub-section, to a fine not exceeding [#50] in respect of each such offence. (2) For the purposes of this section the expression "close season" means the period for the time being fixed by, or by order made under, this Act as the close season for the place where a grey seal is killed, wounded or taken, or, as the case may be, where a boat is used for the purpose of killing, wounding or taking a grey seal.
