HOUSING (MISCELLANEOUS PROVISIONS) AND RENT RESTRICTION LAW (AMENDMENT) ACT (NORTHERN IRELAND) 1956 HOUSING (MISCELLANEOUS PROVISIONS) AND RENT RESTRICTION LAW (AMENDMENT) ACT (NORTHERN IRELAND) 1956 - LONG TITLE An Act to make further and better provision with respect to the improvement of the housing of the people, to amend the law relating to rent restriction, and for purposes connected with those matters. [6th November 1956] Part I (ss.113) rep. by 1964 c.26 (NI) s.14 sch. 1971 c.5 (NI) s.24 sch.3; 1971 c.16 (NI) s.54(3) sch.7; 1973 NI 21 art.72(2) sch.3; SLR 1976; 1977 NI 8 art.14(2) sch. 1981 NI 3 art.163(2) sch.13 Ss.2224 rep. by 1967 c.31 (NI) s.130 sch.10 Pt.I; SLR 1976; 1981 NI 3 art.163(2) sch.13 HOUSING (MISCELLANEOUS PROVISIONS) AND RENT RESTRICTION LAW (AMENDMENT) ACT (NORTHERN IRELAND) 1956 - SECT 25 Amendments as to Small Dwellings Acquisition Acts. 25.(1) The limitation on the amount of an advance under the Small Dwellings Acquisition Acts (Northern Ireland), 1899 to 1948, shall be increased to ninety-five per cent. of the market value of the house in respect of which the advance is made. Subs.(2) amends s.1 of 1899 c.44 (3) The amount of an advance under the Small Dwellings Acquisition Acts (Northern Ireland), 1899 to 1948, which may be made by instalments as the building of the house progresses shall be increased to eighty per cent. of the value of the work done up to that time on the construction of the house. Subs.(4) amends s.5 of 1923 c.30 (NI) Amendment of 1773 c.40 (I) HOUSING (MISCELLANEOUS PROVISIONS) AND RENT RESTRICTION LAW (AMENDMENT) ACT (NORTHERN IRELAND) 1956 - SECT 36 36.(1) Notwithstanding anything contained in an Act passed by the Irish Parliament in the session held in the thirteenth and fourteenth years of the reign of His Majesty King George the Third, Chapter forty, intituled "An Act for settling and preserving a Publick Library in the City of Armagh for ever, and for enabling the Archbishop of Armagh to appropriate Parts of a Piece of waste ground contiguous to the said City to certain Uses for the Benefit of the Inhabitants thereof, and to make long Leases of the Remainder," it shall be lawful for the governors and guardians in, under and by that Act constituted and incorporated to dispose of their estate (a)in one acre, two roods and two perches statute measure of the lands held by the said governors and guardians under the said Act, to the Armagh Urban District Council, for the purposes of the Housing Acts; (b)in one acre, two roods and twenty-seven perches statute measure of the said lands, to the Northern Ireland Housing Trust. (2) Any such disposal may include such easement, quasi-easement or right in, to or over any other lands retained by the said governors and guardians, and may be made subject to such restrictions, exceptions or reservations, as may be agreed upon. (3) Any such disposal shall be for a fair and reasonable consideration or rent, and the proceeds or profits thereof shall be received by the said governors and guardians and applied by them in furtherance of the objects and purposes for which such governors and guardians were by the said Act constituted and incorporated. (4) The receipt in writing of the said governors and guardians or any two or more of them for any sum received by them as aforesaid shall be a valid discharge therefor and shall effectually exonerate the Armagh Urban District Council or, as the case may be, the Northern Ireland Housing Trust, from seeing to the application thereof or being answerable for any loss or misapplication thereof. Where a grant is paid under Part III of the Housing (No. 2) Act (Northern Ireland), 1946, in respect of a house (a)completed after the thirty-first day of August, nineteen hundred and fifty-five; and (b)not exceeding in superficial area nine hundred square feet; Ss.4347 rep. by 1961 c.12 (NI) s.48 sch.3; SLR 1976; 1976 NI 25 art.80(4) sch.6 Pt.II; 1977 NI 8 art.14(2) sch.; 1981 NI 3 art.163(2) sch.13 HOUSING (MISCELLANEOUS PROVISIONS) AND RENT RESTRICTION LAW (AMENDMENT) ACT (NORTHERN IRELAND) 1956 - SECT 48 Recovery of part of certain commuted sums. 48.(1) Where (a)in accordance with a housing subsidy order made under section one of the Housing (No. 2) Act (Northern Ireland), 1946, an annual sum was payable in respect of a house ... to a housing association within the meaning of sub-section (2) of section twelve of the Housing and Local Government (Miscellaneous Provisions) Act (Northern Ireland), 1946; and (b)that annual sum has been commuted; and (c)the house in respect of which the annual sum was payable before commutation has been destroyed or otherwise ceases to be used as housing accommodation; (i)that annual sum had not been commuted; and (ii)the house had not ceased to be used as housing accommodation. (2) Where any annual sum is payable to the Ministry in accordance with sub-section (1), ..., the housing association, may by agreement with the Ministry pay to the Ministry an amount in commutation of that annual sum, or a part thereof, and thereupon such annual sum or part thereof shall be deemed to be commuted accordingly. In this Act the following expressions have the meanings hereby assigned to them, that is to say Definition rep. by 1981 NI 3 art.163(2) sch.13 "flat" means a separate and self-contained set of premises constructed for use for the purposes of a dwelling and forming part of a building from some other part of which it is divided horizontally; "house" ... includes (i)any part of a building, being a part which is occupied or intended to be occupied as a separate dwelling; (ii)a flat; <(iii)any yard, garden, out-house and appurtenances belonging to a house or usually enjoyed therewith; and <(iv)the site of a house; Definitions rep. by 1978 NI 20 art.77(3) sch.10; 1981 NI 3 art.163(2) sch.13 Citation.
