43.(1) Any industrial assurance company which (a)contravenes or fails to comply with (i)any of the provisions of this Order or of Part VI of the Reserve and Auxiliary Forces (Protection of Civil Interests) Act 1951 (as applied to Northern Ireland by any Order in Council under section 65 of that Act); or (ii)any regulation made under Article 49(1)(d) for the purposes of Article 21; or <(iii)any regulation made under section 57 of the said Act of 1951 as so applied; or (b)contravenes or fails to comply with any directions given by the Commissioner under this order; (2) An industrial assurance company shall not be guilty of an offence under this Article consisting in its insuring in contravention of Schedule 3, paragraph 2, if it is proved that, owing to any false representation on the part of the proposer, the company did not know that the insurance was in contravention of that paragraph. (3) A company guilty of an offence under this Article shall be liable on summary conviction to a fine not exceeding #200. (4) So far as regards Article 35(2), this Article does not prejudice any liability of a company subsisting otherwise than by virtue of this Article.
