59.(1) Except as provided by paragraph (2), any provision in an agreement (whether a contract of employment or not) shall be void in so far as it purports (a)to exclude or limit the operation of any provision of this Order; (b)to preclude any person from presenting a complaint to, or bringing any proceedings under this Order before, an industrial tribunal, or from making any reference, claim or complaint under Part III. (2) Paragraph (1) shall not apply (c)to any agreement to refrain from instituting or continuing any proceedings before an industrial tribunal where [the Agency] has taken action in accordance with Article 56(3) or (4); (d)to any agreement such as is referred to in Article 54(6)(b) or (c), or paragraph 11(b) or (c) of Schedule 3, to the extent that it varies or supersedes an award under Article 54, or, as the case may be, paragraph 10 of Schedule 3.
