ROADS IMPROVEMENT ACT (NORTHERN IRELAND) 1928 ROADS IMPROVEMENT ACT (NORTHERN IRELAND) 1928 - LONG TITLE An Act to make further provision with respect to the compulsory acquisition of land for roads and streets, to confer further powers upon local authorities for the improvement of roads and streets, and for the prevention of danger to persons using the same and the relief of congestion of traffic, and for other purposes connected therewith.{1} [4th June 1928] Ss.13 rep. by 1948 c.28 (NI) s.43(2) sch.7. S.6 rep. by 1948 c.28 (NI) s.43(2) sch.7 ROADS IMPROVEMENT ACT (NORTHERN IRELAND) 1928 - SECT 7 Erection and use of petrol pumps along roads. 7.(1) [The Ministry of Development] may, if they think fit, grant to any person a licence to erect, construct or place and maintain, in or under any road, street or footpath...., pumps, pipes or other appliances for supplying motor spirit to mechanically propelled vehicles drawn up in such road or street, and may by bye-laws (a)prescribe the period for which, and conditions upon which, such licence may be granted or withdrawn, and the conditions to be observed in connection with the use and construction of such pumps; and (b)require the payment, in respect of a licence, of such annual fees as may be fixed by the bye-laws; and (c)impose penalties for the erection or use of pumps, pipes or other appliances without a licence under this section. In this section, the expression "motor spirit" means any inflammable hydrocarbon (including any mixture of hydrocarbons and any liquid containing hydrocarbon) which is capable of being used for providing motive power for a mechanically-propelled vehicle. (2) Nothing in this section (a)shall affect or diminish the rights of the owner of the soil of any road, street or footpath to which a licence relates, or of any person claiming under the owner; or (b)shall permit any appliance erected, constructed, placed or maintained under a licence to be used except in accordance with the regulations for the time being in force relating to the storage and sale of motor spirit. The provisions of sections two hundred and nineteen to two hundred and twenty-three, inclusive, of the Public Health (Ireland) Act, 1878, shall apply with respect to bye-laws made by [the Ministry of Development] under this Act.
