Recovery of damages, penalties, &c. 92. No proceedings for the recovery of any penalty incurred under the provisions of this Act shall be taken by any person, other than by a party grieved, or the [district council, Department of the Environment or Ministry of Home Affairs as the case may be], without the consent in writing of Her Majesty's Attorney General first had and obtained and no such penalty shall be recovered unless proceedings for the recovery thereof shall have been commenced within six calendar months after the commission or occurrence of the offence upon which the penalty attaches ...; and notwithstanding the liability of any person to any penalty under the provisions of this Act, he shall be relieved from any other liability to which he would have been subject if this Act had not been passed.
