The Department of the Environment, in exercise of the powers conferred on it by Articles 55(1), (2) and (6), and 110(2) of the Road Traffic (Northern Ireland) Order 1995[1] and of every other power enabling it in that behalf, hereby makes the following Regulations:
Citation, commencement and interpretation
1.
- (1) These Regulations may be cited as the Motor Vehicles (Construction and Use) (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 2nd April 2001.
(2) In these Regulations "the principal Regulations" means the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999[2].
Amendment to regulation 21 (braking systems of vehicles to which regulation 20 does not apply)

In regulation 21(10) of the principal Regulations, after "76/432" there shall be added "or 96/63".
Amendment to regulation 22 (vacuum or pressure brake warning devices)
3.
In regulation 22(2) of the principal Regulations, in paragraph (b), after "76/432" there shall be added "or 96/63".
Amendments to regulation 54 (seat belt anchorage points)
4.
In regulation 54 of the principal Regulations, in paragraphs (4)(b) and (6), after "90/629" there shall be inserted "or 96/38".
Amendments to regulation 55 (seat belts)
5.
- (1) Regulation 55 of the principal Regulations shall be amended in accordance with paragraphs (2) and (3).
(2) In paragraph (4), after "90/628" there shall be inserted "or 96/36".
(3) In paragraph (11) -
(a) in sub-paragraph (i)(b) of the definition of "British Standard mark" for "or BS AU 202a" there shall be substituted ", BS AU 202a or BS AU 202b"; and
(b) in paragraph (ii) of the definition of "designated approval mark" for "and 44B" there shall be substituted ", 44B and 44C".
Revocation of regulation 102 (use of bridging plates between motor vehicle and trailer)
6.
Regulation 102 of the principal Regulations is hereby revoked.
Amendments to Schedule 1 (Community Directives and ECE Regulations)
7.
- (1) Table 1 of Schedule 1 to the principal Regulations shall be amended in accordance with paragraphs (2) and (3).
(2) After item 87 there shall be inserted the following items -

EXPLANATORY NOTE
(This note is not part of the Regulations.)
These Regulations amend the Motor Vehicles (Construction and Use) Regulations (Northern Ireland) 1999.
Regulation 2 amends regulation 21 (braking systems of vehicles to which regulation 20 does not apply) by enabling an agricultural motor vehicle to meet the requirements of the regulation by complying with Council Directive 76/432/EEC as amended by Commission Directive 96/63/EC. Such a vehicle can, as before, meet the requirements of the regulation by complying with Council Directive 76/432/EEC.
Regulation 3 amends regulation 22 (vacuum or pressure brakes waring devices) by disapplying the requirements of the regulation in relation to an agricultural motor vehicle which complies with Council Directive 76/432/EEC as amended by Commission Directive 96/63/EC. These requirements do not, as before, apply to such a vehicle if it complies with Council Directive 76/432/EEC.
Regulation 4 amends regulation 54 (seat belt anchorage points) by enabling a vehicle to meet the requirements of the regulation by complying with Council Directive 76/115/EEC as amended by Council Directive 81/575/EEC, Commission Directive 82/318/EEC, Commission Directive 90/629/EEC and Commission Directive 96/38/EC. A vehicle can, as before, meet the requirements of the regulation by complying with Council Directive 76/115/EEC or with that Directive as amended by Council Directive 81/575/EEC or with that Directive as further amended by Commission Directive 82/318/EEC or with that Directive as further amended by Commission Directive 90/629/EEC.
Regulation 5 amends regulation 55 (seat belts) so as to -
(a) enable a vehicle to meet the requirements of the regulation by complying with Council Directive 77/541/EEC as amended by Commission Directive 82/319/EEC, Commission Directive 90/628/EEC and Commission Directive 96/36/EC (A vehicle can, as before, meet the requirements of the regulation by complying with Council Directive 77/541 or with that Directive as amended by Commission Directive 82/319/EEC or with that Directive as further amended by Commission Directive 90/628/EEC); and
(b) permit the use of a child restraint system marked in accordance with -
(i) ECE Regulation 44 as amended by ECE Regulations 44.01, 44.02 and 44.03; or
(ii) BS AU 202b,
and, in the latter case, bearing the registered certification trade mark of the British Standards Institution.
Regulation 6 revokes regulation 102.
Regulation 7 makes consequential amendments to Table 1 of Schedule 1.
These Regulations have been notified to the European Commission pursuant to the European Parliament and Council Directive 98/34/EC of 22nd June 1998 laying down a procedure for the provision of information in the field of technical standards and regulations (O.J. No. L204, 21.7.98, p. 37).
