SOCIAL SECURITY; STATUTORY MATERNITY PAY

The Social Security (Medical Evidence) and Statutory Maternity Pay (Medical Evidence) (Amendment) Regulations (Northern Ireland) 2001

  Made 21st August 2001 
  Coming into operation 28th September 2001 

The Department for Social Development, in exercise of the powers conferred by sections 5(1)(j), 13(1)(a) and 165(1), (4) and (5) of the Social Security Administration (Northern Ireland) Act 1992[1], and now vested in it[2], and of all other powers enabling it in that behalf, and with the concurrence of the Inland Revenue in so far as their concurrence is required[3], hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Social Security (Medical Evidence) and Statutory Maternity Pay (Medical Evidence) (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 28th September 2001.

    (2) The Interpretation Act (Northern Ireland) 1954[
4] shall apply to these Regulations as it applies to an Act of the Assembly.

Amendment of the Social Security (Medical Evidence) Regulations
     2.  - (1) The Social Security (Medical Evidence) Regulations (Northern Ireland) 1976[5] shall be amended in accordance with paragraphs (2) and (3).

    (2) In regulation 2(3)[6] (evidence of incapacity for work and confinement) after "given by a doctor or by a registered midwife" there shall be inserted ", not earlier than the beginning of the 20th week before the expected week of confinement,".

    (3) In Part II of Schedule 2[7] (form of maternity certificate) for "14 weeks" there shall be substituted "20 weeks".

Amendment of the Statutory Maternity Pay (Medical Evidence) Regulations
     3.  - (1) The Statutory Maternity Pay (Medical Evidence) Regulations (Northern Ireland) 1987[8] shall be amended in accordance with paragraphs (2) and (3).

    (2) In regulation 2 (evidence of pregnancy and confinement) for "14th week") there shall be substituted "20th week".

    (3) In Part II of the Schedule (form of maternity certificate) for "14 weeks" there shall be substituted "20 weeks".

EXPLANATORY NOTE

(This note is not part of the Regulations.)


These Regulations amend the Social Security (Medical Evidence) Regulations (Northern Ireland) 1976 and the Statutory Maternity Pay (Medical Evidence) Regulations (Northern Ireland) 1987 to provide for the maternity certificate to be given not more than 20 weeks before the week the baby is expected.

These Regulations make in relation to Northern Ireland only provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992, are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.

These Regulations do not impose a charge on business.
