SOCIAL SECURITY
The Social Security Fraud (2001 Act) (Commencement No. 3) Order (Northern Ireland) 2002
The Department for Social Development, in exercise of the powers conferred on it by section 17(1) of the Social Security Fraud Act (Northern Ireland) 2001[1] and of all other powers enabling it in that behalf, hereby makes the following Order:
Citation and interpretation
1.
- (1) This Order may be cited as the Social Security Fraud (2001 Act) (Commencement No. 3) Order (Northern Ireland) 2002.
(2) In this Order "the Act" means the Social Security Fraud Act (Northern Ireland) 2001.
Appointed day
2.
The day appointed for the coming into operation of -
(a) section 5 of the Act (supply of information);
(b) section 13 of the Act (delegation of functions);
(c) section 14 of the Act (colluding employers); and
(d) the Schedule to the Act (repeals), (except in so far as it relates to section 104A(7) of the Social Security Administration (Northern Ireland) Act 1992) and section 16 of the Act in so far as it relates to that Schedule,
is 1st May 2002.

EXPLANATORY NOTE
(This note is not part of the Order.)
This Order provides for the coming into operation on 1st May 2002 of the following provisions of the Social Security Fraud Act (Northern Ireland) 2001 -
section 5 which enables the Department to give directions to the Housing Executive in relation to the supply by them of housing benefit information;
sections 13 and 14 which relate to provision for civil penalties as an alternative to prosecution for benefit offences; and
section 16 and the Schedule which provide for consequential repeals, except for the repeal of the word "and" at the end of section 104A(7)(a) of the Social Security Administration (Northern Ireland) Act 1992.
This Order does not impose a charge on business.
NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Social Security Fraud Act (Northern Ireland) 2001 have been brought into operation by earlier commencement orders as from the dates shown.
