The Department of Agriculture and Rural Development, being a Department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures in the veterinary and phytosanitary fields for the protection of public health, in exercise of the powers conferred on it by the said section 2(2), hereby makes the following Regulations:
Citation and commencement

These Regulations may be cited as the Transmissible Spongiform Encephalopathy (Amendment) Regulations (Northern Ireland) 2005 and shall come into operation on 1st March 2005.
Amendment to the Transmissible Spongiform Encephalopathy Regulations (Northern Ireland) 2002
2.
- (1) The Transmissible Spongiform Encephalopathy Regulations (Northern Ireland) 2002[3] are amended in accordance with this Regulation.
(2) In regulation 99 (Offences and penalties) in paragraph (2) for the words "under this regulation" substitute the words "under these Regulations".

EXPLANATORY NOTE
(This note is not part of the Regulations.)
These Regulations correct a technical defect in regulation 99 of the Transmissible Spongiform Encephalopathy Regulations (Northern Ireland) 2002 ("the 2002 Regulations"). Paragraph (1) of that regulation makes it an offence to contravene any requirement or prohibition of the 2002 Regulations but only where such a contravention was not an offence under any other provision of those Regulations. The following paragraph, as originally made, provided penalties for offences created by paragraph (1) but not for offences created by the other provisions of the 2002 Regulations. These Regulations amend regulation 99(2) of the 2002 Regulations to make it clear that the penalties provided thereunder apply in the case of all offences under the 2002 Regulations.
