STATUTORY RULES OF NORTHERN IRELAND

ENVIRONMENTAL PROTECTION
The List of Wastes (Amendment) Regulations (Northern Ireland) 2005

	Made	21st October 2005
	Coming into operation	14th November 2005

The Department of the Environment, being a Department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to measures relating to the prevention, reduction and elimination of pollution caused by waste and of all other powers enabling it in that behalf, hereby makes the following Regulations:

Citation and commencement
     1. —(1) These Regulations may be cited as the List of Wastes (Amendment) Regulations (Northern Ireland) 2005, and shall come into operation on 14 November 2005.

    (2) The Interpretation Act (Northern Ireland) 1954[3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the List of Wastes Regulations (Northern Ireland) 2005
     2. —(1) The List of Wastes Regulations (Northern Ireland) 2005[4] shall be amended in accordance with paragraphs (2) and (3).

    (2) In regulation 2 (interpretations) in sub-paragraph (b) for "Council Regulation (EC) No.807/2003" there shall be substituted "Commission Directive 2004/73/EC[5]".

    (3) In regulation 4(b) (properties and characteristics of dangerous substances classified as hazardous waste) for "R40 at a concentration = 1% ." there shall be substituted "R68 at a concentration = 1% ".

These Regulations correct minor errors in the List of Wastes Regulations (Northern Ireland) 2005 (S.R. 2005 No.301).
