The Disability Discrimination (Code of Practice) (Further and Higher Education) (Appointed Day) Order (Northern Ireland) 2006
The Department for Employment and Learning[1], in exercise of the powers conferred by sections 54A(6)(a) and 67(2) and (3)(a) of the Disability Discrimination Act 1995[2] and now vested in it[3], hereby makes the following Order:

This Order may be cited as the Disability Discrimination (Code of Practice) (Further and Higher Education) (Appointed Day) Order (Northern Ireland) 2006.
Code of Practice

30th January 2006 is the day appointed for the coming into effect of the Disability Discrimination Code of Practice for Further and Higher Education issued by the Equality Commission for Northern Ireland under section 54A of the Disability Discrimination Act 1995 on 5th January 2006.

EXPLANATORY NOTE
(This note is not part of the Order)
This Order brings the Disability Discrimination Code of Practice for Further and Higher Education into effect on 30th January 2006. The Code of Practice was issued by the Equality Commission for Northern Ireland under section 54A of the Disability Discrimination Act 1995.
The Code provides practical guidance for Further and Higher Education Institutions on how to avoid committing acts which are unlawful under, and other matters relating to, the operation of Part III Chapter II of the Special Educational Needs and Disability (Northern Ireland) Order 2005 which came into effect from 1st September 2005.
Failure to observe any provision of this Code does not in itself make a person liable to any proceedings but, any provision of the Code which appears to a court to be relevant to any question arising in any proceedings must be taken into account in determining that question.
