The Department for Social Development makes the following Regulations in exercise of powers conferred by Article 38(1) and (3) of the Social Security (Northern Ireland) Order 1998[1] and now vested in it[2].
Citation and commencement
1.
These Regulations may be cited as the Social Fund (Application for Review) (Amendment) Regulations (Northern Ireland) 2006 and shall come into operation on 24th April 2006.
Amendment of the Social Fund (Application for Review) Regulations
2.
In regulation 2 of the Social Fund (Application for Review) Regulations (Northern Ireland 1988[3] (manner of making application for review or further review and time limits) for paragraph (1) there shall be substituted—
"
(1) Any application for—
(a) a review of any determination made by an appropriate officer shall be in writing and shall be made within the time specified in paragraph (2) by sending or delivering it to an office of the Department for Social Development;
(b) a further review by a social fund inspector of a determination of an appropriate officer which has been reviewed shall be in writing and shall be made within the time specified in paragraph (2) by sending or delivering it to—
(i) for the period up to 1st April 2007, either the Office of the Social Fund Commissioner or an office of the Department for Social Development,
(ii) for the period from and including 2nd April 2007, the Office of the Social Fund Commissioner only."
Revocation
3.
Article 10(a) of the Social Security (1998 Order) (Commencement No. 11 and Consequential and Transitional Provisions) Order (Northern Ireland) 1999[4] is hereby revoked.

EXPLANATORY NOTE
(This note is not part of the Regulations.)
Regulation 2 of these Regulations amends the Social Fund (Application for Review) Regulations (Northern Ireland) 1988 by providing that an application for review by a social fund inspector may be made to the Office of the Social Fund Inspector or, until 1st April 2007, to an office of the Department for Social Development.
(Applications for review by an appropriate officer will continue to be sent or delivered to an office of the Department for Social Development).
Regulation 3 makes a consequential revocation.
These Regulations make, in relation to Northern Ireland only, provision corresponding to provision contained in Regulations made by the Secretary of State for Work and Pensions in relation to Great Britain and accordingly, by virtue of section 149(3) of, and paragraph 10 of Schedule 5 to, the Social Security Administration (Northern Ireland) Act 1992 (c. 8), are not subject to the requirement of section 149(2) of that Act for prior reference to the Social Security Advisory Committee.
A regulatory impact assessment has not been produced for this rule as it has no impact on the costs of business.
