CLEAN AIR

The Smoke Control Areas (Authorised Fuels) (Amendment) Regulations (Northern Ireland) 2007

  Made 10th January 2007 
  Coming into operation 11th February 2007 

The Department of the Environment makes the following Regulations in exercise of the powers conferred upon it by Article 2 (2) of the Clean Air (Northern Ireland) Order 1981[1].

     In accordance with that Article the Department has had regard, amongst other things, to the sulphur content of the fuels described in regulation 2.

Citation, commencement and interpretation
     1. —(1) These Regulations may be cited as the Smoke Control Areas (Authorised Fuels) (Amendment) Regulations (Northern Ireland) 2007 and shall come into operation on 11th February 2007.

    (2) In these Regulations "the principal Regulations" means the Smoke Control Areas (Authorised Fuels) Regulations (Northern Ireland) 2003[
2].

Amendment to the principal Regulations
     2. —(1) The Schedule (authorised fuels) to the principal Regulations is amended as follows.

    (2) In paragraph 3 (e), for "1.5 per cent" substitute "2 per cent".

    (3) After paragraph 6 insert the following paragraph—

    (5) After paragraph 23 insert the following paragraph—

    (6) In paragraph 25(e), for "1.5 per cent" substitute "2 per cent".

    (7) After paragraph 27, insert the following paragraph—

    (8) In paragraph 32(d), for "75 grammes" substitute "80 grammes".

    (9) After paragraph 33, add the following paragraphs—

Savings
    
3. Notwithstanding the amendments made by regulation 2 (2), (6) and (8) to paragraphs 3, 25 and 32 of the Schedule to the principal Regulations, any of the fuels in those paragraphs manufactured before the 11th February 2007 which immediately before that date was an authorised fuel shall continue to be an authorised fuel.

(This note is not part of the Regulations)


The Smoke Control Areas (Authorised Fuels) Regulations (Northern Ireland) 2003 ("the 2003 Regulations") prescribed authorised fuels for the purpose of the Clean Air (Northern Ireland) Order 1981.
