The Foyle, Carlingford and Irish Lights Commission, with the approval of the North/South Ministerial Council, makes the following Regulations in exercise of the powers conferred by section 13(1) of the Foyle Fisheries Act 1952 (1) and section 13(1) of the Foyle Fisheries Act (Northern Ireland) 1952 (2) and now vested in it (3).
1.–(1) These Regulations may be cited as the Foyle Area and Carlingford Area (Conservation of Eels) Regulations 2009 and shall come into operation on the 1st January 2010.
(2) These Regulations apply in the Foyle Area and the Carlingford Area.
2. In these Regulations "eels" means fish of the species Anguilla anguilla.
3.–(1) Subject to paragraph (2), a person shall not take eels by any mode other than rod and line.
(2) Any eels taken by rod and line shall be carefully handled and returned immediately to the waters from which they were taken without avoidable injury.
4. A person shall not sell or offer for sale eels caught by rod and line.

These Regulations apply to the Foyle Area and Carlingford Area and prohibit the catching of eels by any mode other than by rod and line. They also provide that eels caught by rod and line are returned to the waters from where they were caught without avoidable injury and prohibit the sale of eels caught by rod and line.
