The Misuse of Drugs (Licence Fees) Regulations (Northern Ireland) 2011

The Department of Health, Social Services and Public Safety makes the following Regulations in exercise of the powers conferred by sections 30, and 31 of the Misuse of Drugs Act 1971(1) as adapted by sections 31(4) and 38(1) of that Act and now vested in it(2).

In accordance with section 31(3) of that Act, it has consulted with the Advisory Council on the Misuse of Drugs.

Citation and commencement

1. These Regulations may be cited as the Misuse of Drugs (Licence Fees) Regulations (Northern Ireland) 2011 and shall come into operation on 22nd March 2011.

Interpretation

2. The Interpretation Act (Northern Ireland) 1954(3) shall apply to these Regulations as it applies to an Act of the Assembly.

Prescribed Fee

3.-(1) Where a licence is issued under section 3(2)(b) of the Misuse of Drugs Act 1971 (restriction of importation and exportation of controlled drugs), the fee payable shall be £24.

(2) Where a person has lost a licence issued under paragraph (1) or where such a licence has been defaced or damaged, and that licence is re-issued to him, the fee payable shall be £45.

4. Revocation

The Misuse of Drugs (Licence Fees) Regulations (Northern Ireland) 1979(4) are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations prescribe the fee where a licence is issued in connection with the importation or exportation of controlled drugs, (see regulation 3(1)), regulation 3(2) prescribes the fee where a licence has been lost or where the licence has been defaced or damaged and is reissued to the owner. The Regulations also revoke the Misuse of Drugs (Licence Fees) Regulations (Northern Ireland) 1979.

The Department of Health and Social Services was later renamed Department of Health, Social Services and Public Safety by Article 3(6) of S.I 1999/238(N.I.1)
