The Department of the Environment makes the following Regulations in exercise of the powers conferred by Article 17(7) of the Clean Air (Northern Ireland) Order 1981(1).
The Department is satisfied that the classes of fireplace set out in column 1 of the Schedule can, subject to the conditions set out in column 2 of the Schedule, be used for burning fuel other than authorised fuels(2) without producing any smoke or a substantial quantity of smoke.
1.-(1) These regulations may be cited as the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2015 and come into operation on 16th July 2015.
(2) In these Regulations, "the Principal Regulations" mean the Smoke Control Areas (Exempted Fireplaces) (No. 2) Regulations (Northern Ireland) 2013(3).
2.-(1) The Schedule to the Principal Regulations is amended in accordance with paragraphs (2) to (4).
(2) In the first column, under the heading "(1) Class of fireplace"-
(a)in the classes of fireplace beginning with the words-
"PROPEL P25"; and
"SLIMPEL S25",
insert "Green Energy Engineering" at the beginning of the entry, and before the name of the fireplace;
(b)in the class of fireplace beginning with the words-
"Robus Black Star",
after "Republic", insert "and pellet burners manufactured by NBE Productions A/S, Kjeldgaardsvej 2, 9300 Saeby, Denmark"; and
(c)in the classes of fireplace beginning with the word-
"Firebelly",
for each time that it appears, for "Unit C Ainleys Industrial Estate, Elland, HX5 9JP", substitute "Unit B Marshall Hall Mills, Elland, HX5 9DU".
(3) The classes of fireplace beginning with the words-
(a)"Amalia 5";
(b)"Amalia 7";
(c)"Hestia 5";
(d)"Hestia 7";
(e)"Hillandale Silverdale 5 SE"; and
(f)"Hillandale Silverdale 7 SE";
and the respective conditions are omitted.
(4) At the appropriate places in the Schedule to the Principal Regulations insert the classes of fireplace and the respective conditions set out in the Schedule to these Regulations.

(This note is not part of the Regulations)
The Smoke Control Areas (Exempted Fireplaces) (No. 2) Regulations (Northern Ireland) 2013 ("the 2013 Regulations") specify those fireplaces exempted from the provisions of Article 17(7) of the Clean Air (Northern Ireland) Order 1981.
Article 17 generally prohibits the emission of smoke from chimneys in smoke control areas. However, under paragraph 7 of Article 17, the Department of the Environment may exempt certain classes of fireplaces from the provisions of Article 17, if it is satisfied that they can be used for burning fuel other than authorised fuels, without producing any smoke, or a substantial quantity of smoke.
These Regulations amend the 2013 Regulations to include a number of additional fireplaces to the Schedule that have been tested and found to be suitable for use in smoke control areas. There are also minor amendments to some existing fireplaces.
