The Environmental Better Regulation (2016 Act) (Commencement No. 2) Order (Northern Ireland) 2016

The Department of Agriculture, Environment and Rural Affairs makes the following Order in exercise of the powers conferred by section 27(2) of the Environmental Better Regulation Act (Northern Ireland) 2016(1).

Citation

1.  This Order may be cited as the Environmental Better Regulation (2016 Act) (Commencement No. 2) Order (Northern Ireland) 2016.

Appointed day

2.  The day appointed for the coming into operation of sections 15, 16 and 26(2) of, and Schedule 3 to the Environmental Better Regulation Act (Northern Ireland) 2016 is 10th October 2016.

EXPLANATORY NOTE

(This Note is not part of the Order)

This Order brings sections 15, 16 and 26(2) of, and Schedule 3 to, the Environmental Better Regulation Act (Northern Ireland) 2016 into operation.

The purpose of this Order is to enable fireplaces and fuels which cause only limited amounts of smoke pollution to become officially designated for use in smoke control areas in Northern Ireland without the need for legislation to be compiled.

Instead, the fuels and fireplaces are designated as being suitable for use in smoke control areas once added to lists kept by the Department of Agriculture, Environment and Rural Affairs, and published in a manner that it considers appropriate.

The lists are currently available to the public on request from the Department of Agriculture, Environment and Rural Affairs, Goodwood House, 44-58 May Street, Town Parks, Belfast BT1 4NN. The lists can also be found at the following web-sites:

The following Regulations are impliedly revoked by the making of this Order-

a

the Smoke Control Areas (Authorised Fuels) (Amendment) Regulations (Northern Ireland) 2015(2);

b

the Smoke Control Areas (Exempted Fireplaces) (Amendment) Regulations (Northern Ireland) 2015(3); and

c

the Smoke Control Areas (Exempted Fireplaces) (Amendment No. 2) Regulations (Northern Ireland) 2015(4).

NOTE AS TO EARLIER COMMENCEMENT ORDERS

The following provisions of the Environmental Better Regulation Act (Northern Ireland) 2016 have been brought into operation by a commencement order made before the date of this Order-
