The Waste and Contaminated Land (Amendment) (2011 Act) (Commencement No.3) Order (Northern Ireland) 2022

The Department of Agriculture, Environment and Rural Affairs( 1), in exercise of the powers conferred by sections 12(1) of the Waste and Contaminated Land (Amendment) Act (Northern Ireland) 2011( 2), makes the following Order:

Citation

1.  This Order may be cited as the Waste and Contaminated Land (Amendment) (2011 Act) (Commencement No.3) Order (Northern Ireland) 2022.

Appointed Day

2.  The appointed day for the coming into operation of –

(a) Section 4 (powers to require removal of waste unlawfully deposited); and

(b) Section 5 (councils to enforce Articles 4 and 5 of 1997 Order), of the Waste and Contaminated land (Amendment) Act (Northern Ireland) 2011 is 2nd January 2023.

EXPLANATORY NOTE

(This note is not part of the Order)

This order brings into operation sections 4 and 5 of the Waste and Contaminated Land (Amendment) Act (Northern Ireland) 2011 on 2nd January 2023.

The following provisions of the Waste and Contaminated Land (Amendment) Act (Northern Ireland) 2011 have been brought into operation by a commencement order made before the date of this Order—

Formerly the Department of Agriculture and Rural Development (DARD see Article 3(4) of the Departments (Northern Ireland) Order 1999 ( S.I. 1999/283 (N.I.1)). DARD was renamed the Department of Agriculture, Environment and Rural Affairs (DAERA) by Article 1(2) of the Departments Act (Northern Ireland) 2016 ( 2016 c.5 (N.I)). The Department of the Environment was dissolved by section 1(9) of the Departments Act (Northern Ireland) 2016 and, by virtue of Article 8(1)(c) of the Departments (Transfer of Functions) Order (Northern Ireland) 2016, its functions for the purpose of these Regulations were transferred to the Department of Agriculture, Environment and Rural Affairs.
