Subject_Proving of the Tenor.—
Adminicles sustained (along with a talis qualis proof of the casus amissionis) in proving the tenor of a disposition of lands, which was, in some respects, of an unusual character.
This was a proving of the tenor of a disposition of the northern half of the lands of Glendale, &c., The disposition proceeded on the narrative, that the disponer was pro indiviso proprietor along with a lunatic, and that the Court had decerned in a declarator of division of the lands. It was dated 1st April, 1811, and there were now produced, as adminicles, the draft of the deed; instrument of sasine following on it, dated 11th October, and recorded 16th November, 1811; and charter of confirmation of the disposition, dated 20th and 27th March, 1829. A talis qualis proof of the casus amissionis was also adduced.
The Court decerned in terms of the libel.
