[1] In this action the circumstances are essentially identical to those in the action between the present pursuers and Laurieston Homes (Howwood) Limited and the current second defenders in respect of which I have delivered an opinion on the issue in dispute. The only differences concern the respective figures in relation to the amounts arrested. Parties were agreed that my opinion in the Howwood action should govern this action also. [2] I shall therefore grant decree of furthcoming de plano in this action also.
