OPINION OF LORD GLENNIE
in the Petition of
KLIN INVESTMENT UK LIMITED
Petitioner;
for
Judicial Review of a decision of Ian Strathdee, Adjudicator, dated 1 May 2009 ________________
|
Petitioners: Malone; Bell & Scott LLP
Respondents: Smith; Pinsent Masons LLP
17 July 2009
[1] In my Opinion in the case of Barr Limited v. Klin
Investment UK Limited (Action CA68/09) I explained the circumstances in
which this petition was presented. It came on for hearing at the same time as
the debate and motion for summary decree in that action. It was agreed that
the disposal of this petition would reflect the decision in the action.
[2] In the action I have decided to grant summary decree in favour
of the pursuers, on the basis that I have rejected the grounds advanced by the
present petitioners, the defenders in that action, for reduction of the
adjudicator's decision. In those circumstances I shall refuse the prayer of
the petition.
