The Scottish Ministers, in exercise of the powers conferred on them bysection 1(1) and (2) and section 24(3) of the Food and EnvironmentProtection Act 1985[1] and of all other powers enabling them inthat behalf, being of the opinion that there exist or may existcircumstances which are likely to create a hazard to human health throughhuman consumption of food and that in consequence food which is derived ormay be in the future derived from bivalve molluscs in the areas describedin the following Order, is, or may be, or may become, unsuitable for humanconsumption, hereby make the following Order: Citation, commencement and interpretation 1. - (1) This Order may be cited as the Food Protection (Emergency Prohibitions)(Amnesic Shellfish Poisoning) (West Coast) (No. 2) (Scotland) Order 2000and shall come into force at 1700 hours on 17th August 2000. (2) In this Order-
(b) "relevant time" means 0001 hours on 17th August 2000.
Designated circumstances
(b) land any scallops which were in waters in a designated area after therelevant time; (c) supply, or have in possession for supply, any scallops which were in adesignated area after the relevant time; (d) supply, or have in possession for supply, any food or anything fromwhich food could be derived in the preparation or processing of whichanything was used in contravention of paragraph (a) of this article; or (e) feed to any creature a feeding stuff in the preparation or processingof which anything was used in contravention of paragraph (a) of thisarticle.
AREA 1 The area of sea below high water springs enclosed by a line startingfrom a point at 58( North latitude 5(30' West longitude; then south to themainland at Gruinard Bay at 57(51.8' North latitude 5(30' West longitude;then south along the mainland shore to 57(30' North latitude 5(52' Westlongitude; then west to a point on the east coast of Skye at 57(30' Northlatitude 6(08.8' West longitude; then north, west, south and east aroundthe coast of Skye to 57(15' North latitude 5(39' West longitude; then eastto the mainland at 57(15' North latitude 5(38.4' West longitude; then southalong the shoreline to 56(41' North latitude 6( West longitude; then southto Auliston Point at 56(39' North latitude 6( West longitude; then south to56(37' North latitude 6( West longitude; then south to 56(35' Northlatitude 6( West longitude; then north, west and south-east along the coastof Mull to 56(30' North latitude 6(09' West longitude; then west toScarinish on Tiree at 56(30' North latitude 6(48.2' West longitude; thennorth and west along the Tiree shore to 56(30' North latitude 7( Westlongitude; then north to 57(45' North latitude 7( West longitude; then eastto 57(45' North latitude 6(30' West longitude; then north to 57(56.4' Northlatitude 6(30' West longitude; then north along the east coast of Lewis toSrianach at 58( North latitude 6(23' West longitude; then east to the pointof beginning. AREA 2 The area of sea below high water springs enclosed by a line startingfrom a point 56°30' North latitude 5(46.5 West longitude; then east to56(30' North latitude 5(41.4' West longitude; then east along the shorelineto 56(30' North latitude 5(40.8' West longitude; then east to Rubh AirdEirinish at 56(30' North latitude 5(34.2' West longitude; then south andeast along the Lismore shore to 56(30' North latitude 5(30.2' Westlongitude; then east to 56(30' North latitude 5(30' West longitude; thensouth to 56(25.6' North latitude 5(30' West longitude on Kerrera; thenwest, south and north along the Kerrera shore to 56(24.7' North latitude5(30' West longitude; then south to 56(24.3' North latitude 5(30' Westlongitude on the mainland; then south to 56(15' North latitude 5(37' Westlongitude; then west to 56(15' North latitude 6( West longitude; then northto the south coast of Mull at 56(19' North latitude 6( West longitude; theneast and north along the coast of Mull to the point of beginning AREA 3 The area of sea below high water springs enclosed by a line startingfrom a point at 56( North latitude 5(40.5' West longitude; then west to 56(North latitude 5(48.2' West longitude on the east coast of Jura; then southalong the coast of Jura to 55(48' North latitude 6( West longitude; thensouth to 55(45' North latitude 6( West longitude; then west to 55(45' Northlatitude 6(03' West longitude on the east coast of Islay; then south, westand north to Port Wemyss at 55(40.5' North latitude 6(30' West longitude;then south to the point of intersection with the Scottish Adjacent Watersboundary line described in article 3(b) of the Scottish Adjacent WatersBoundaries Order 1999[2] on the 6°30' West line oflongitude; then east and south along that boundary line to a point wherethat boundary line intersects the 55°15' North line of latitude; theneast to 55°15' North latitude 5°30' West longitude; then north to55°31.6' North latitude 5°30' West longitude; then south, west andnorth along the shoreline of the Mull of Kintyre to the point of beginning. EXPLANATORY NOTE (This note is not part of the Order) This Order, which forms part of Scots law only, contains emergencyprohibitions restricting various activities in order to prevent humanconsumption of food rendered unsuitable for that purpose by virtue ofshellfish having been affected by the toxin which causes amnesic shellfishpoisoning in human beings. The Order designates three areas of sea off the west coast of Scotlandwithin which taking scallops is prohibited (articles 3 and 4 and theSchedule). It prohibits the movement of scallops out of those areas(article 5). Other restrictions are imposed in relation to the use of anyscallops taken from those areas (article 6). It is an offence by virtue of section 1(6) of the Food and EnvironmentProtection Act 1985 ("the Act") as read with Schedule 1, paragraph 4to the Act as inserted by paragraph 10(13) of the Schedule to the ScotlandAct 1998 (Modification of Functions) Order 1999 (S.I. 1999/1756), tocontravene any of the prohibitions contained in this Order anywhere in theUnited Kingdom or in United Kingdom waters. Under section 21 of the Act the penalty for contravening an emergencyprohibition is-
(b) on conviction on indictment, an unlimited fine, or imprisonment for aterm of not more than two years, or both.
Powers of enforcement in relation to emergency prohibitions areconferred by section 4 of, and Schedule 2 to, the Act. Obstruction ofenforcement officers is an offence under paragraph 10 of that Schedule.
