EDUCATION

The Standards in Scotland's Schools etc. Act 2000 (Commencement No. 6) Order 2003

  Made 10th February 2003 

The Scottish Ministers, in exercise of the powers conferred by section 61(2) of the Standards in Scotland's Schools etc. Act 2000[1], hereby make the following Order:

Citation
     1. This Order may be cited as the Standards in Scotland's Schools etc. Act 2000 (Commencement No. 6) Order 2003.

Appointed Day
    
2. 1st August 2003 is the day appointed for the coming into force of section 15 (requirement that education be provided in mainstream schools) of the Standards in Scotland's Schools etc. Act 2000.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings into force on 1st August 2003 section 15 of the Standards in Scotland's Schools etc. Act 2000. Section 15 establishes a statutory presumption in favour of "mainstream education" where an education authority is providing school education. "Mainstream education" in this context refers to education in a school other than a special school. Section 15 also recognises that a mainstream setting may not be appropriate in all cases and sets out circumstances where an education authority may decide to offer education in a special school.
