CIVIL CONTINGENCIES

The Civil Contingencies Act 2004 (Commencement) (Scotland) Order 2005

  Made 5th October 2005 

The Scottish Ministers, in exercise of the powers conferred by section 34(2) and (3) of the Civil Contingencies Act 2004[1] and of all other powers enabling them in that behalf, hereby make the following Order:

Citation
     1. This Order may be cited as the Civil Contingencies Act 2004 (Commencement) (Scotland) Order 2005.

Interpretation
    
2. In this Order "the Act" means the Civil Contingencies Act 2004.

Provisions coming into force on 6th October 2005
    
3. The following provisions of the Act shall come into force on 6th October 2005:–

Provisions coming into force on 14th November 2005
    
4. The following provisions of the Act shall come into force on 14th November 2005:–

Provision coming into force on 15th May 2006
    
5. Section 4(1) of the Act in so far as this provision relates to section 4(3) or (7) shall come into force on 15th May 2006 to the extent not already in force.

EXPLANATORY NOTE

(This note is not part of the Order)


This Order brings into force the remaining provisions of Part 1 of the Civil Contingencies Act 2004 ("the Act").

Article 3 brings various provisions into force on 6th October 2005 to enable the Scottish Ministers to make and lay regulations to come into force on the 14th November 2005.

Article 4 commences various provisions of Part 1 of the Act on 14th November 2005 to coincide with the regulations which will come into force on that date. Section 4(1) of the Act is commenced on this date only for the purpose of permitting local authorities to provide advice and assistance to the public in relation to business continuity.

Article 5 commences in full the duty imposed by section 4(1) of the Act on the 15th May 2006.
