LOCAL GOVERNMENT

The Local Government in Scotland Act 2003 (Commencement No. 3) Order 2006

  Made 28th February 2006 

The Scottish Ministers, in exercise of the powers conferred by section 62(2) of the Local Government in Scotland Act 2003[1], and of all other powers enabling them in that behalf, hereby make the following Order:

Citation and Interpretation
     1. —(1) This Order may be cited as the Local Government in Scotland Act 2003 (Commencement No. 3) Order 2006.

    (2) In this Order, "the Act" means the Local Government in Scotland Act 2003.

Appointed Day
    
2. —(1) Sub-sections (2) to (6) of section 47 of the Act (power to provide funds for private water supplies) shall come into force on 20th March 2006.

    (2) Sub-sections (1) and (7) of section 47 of the Act shall come into force on 3rd July 2006.

EXPLANATORY NOTE

(This note is not part of the Order)


Article 2 of this Order appoints days for the coming into force of section 47 of the Local Government in Scotland Act 2003 ("the Act").

Section 47(1) imposes a duty upon local authorities to make grants to eligible persons to enable them to improve their private water supply, or to enable them to provide themselves with a private water supply.

Section 47(3) further provides that the Scottish Ministers may, by Regulations, make provision for the making of applications for such grants.

The Act received Royal Assent on 11th February 2003. Sections 42(1), 42(2), 50 and 62 came into force on Royal Assent. The first commencement order was made on 4th March 2003 (S.S.I. 2003/134 (C.7)), and the second commencement order was made on 29th January 2004 (S.S.I. 2004/28 (C.1)). The provisions of the Act remaining to be commenced for all purposes after the making of this Order are sections 8, 9, 11 and 40.
