The Food Hygiene (Scotland) Amendment Regulations 2007

The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1] and of all other powers enabling them in that behalf, after consultation as required by Article 9 of Regulation (EC) No. 178/2002 of the European Parliament and of the Council laying down the general principles and requirements of food law, establishing the European Food Safety Authority and laying down procedures in matters of food safety[2], hereby make the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Food Hygiene (Scotland) Amendment Regulations 2007 and shall come into force on 14th February 2007.

Amendments to the Food Hygiene (Scotland) Regulations 2006
    
2. — The Food Hygiene (Scotland) Regulations 2006[3] are amended in accordance with paragraphs (2) and (3).(2) In regulation 2(1) (interpretation) for "Directive 2004/41" to "the meanings respectively given to them in Schedule 1" substitute–

    (3) For Schedule 1 (definitions of Community legislation) substitute the Schedule set out in the Schedule to these Regulations.

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend the Food Hygiene (Scotland) Regulations 2006 (S.S.I. 2006/3) to reflect recent amendments to the Community instruments referred to in Schedule 1 of those Regulations. They revise the list of Community instruments that is contained in regulation 2(1) (interpretation) of those Regulations and substitute a revised Schedule 1 (definitions of Community legislation) for Schedule 1 to those Regulations (regulation 2(2) and (3)).

A Regulatory Impact Assessment of the effect that those amendments to the Community instruments will have on the costs of business has been prepared and placed in the Scottish Parliament Information Centre. Copies may be obtained from the Food Standards Agency (Scotland), 6th Floor, St Magnus House, 25 Guild Street, Aberdeen, AB11 6NJ.

[1] 1972 c.68 ("the 1972 Act"). Section 2(2) was amended by the Scotland Act 1998 (c.46) ("the 1998 Act"), Schedule 8, paragraph 15(3). The function conferred on the Minister of the Crown under section 2(2) of the 1972 Act, so far as within devolved competence, was transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act.
