The Central Institutions (Recognition) (Scotland) Revocation Regulations 2008

The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 135(1) of the Education (Scotland) Act 1980(1) and all other powers enabling them to do so.

Citation and commencement

1. These Regulations may be cited as the Central Institutions (Recognition) (Scotland) Revocation Regulations 2008 and come into force on 1st June 2008.

Revocation of the Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990

2. The Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990(2) are revoked.

Explanatory Note

(This note is not part of the Regulations)

These Regulations revoke the Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990 ("the 1990 Regulations") as a consequence of the designation of The Scottish Agricultural College (the only remaining body recognised as a Central Institution under the 1990 Regulations) as an institution providing higher education for the purposes of the Further and Higher Education (Scotland) Act 1992 (c. 37). That designation is effected by the Designation of Institutions of Higher Education (The Scottish Agricultural College) (Scotland) (No. 2) Order 2008 (S.S.I. 2008/177).

1980 c. 44. Section 135(1) contains a definition of "central institution" which includes the statutory powers under which the Central Institutions (Recognition) (Scotland) (No. 2) Regulations 1990 were made. The functions of the Secretary of State were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c. 46). Back [1]
