The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 50 of the Local Government (Scotland) Act 1973(1), sections 11 and 16 of the Local Governance (Scotland) Act 2004(2) and all other powers enabling them to do so.

They have considered the information, advice and recommendations given to them by the Scottish Local Authorities Remuneration Committee, in accordance with the requirements of section 11(4) of the Local Governance (Scotland) Act 2004.

Citation and commencement

1. These Regulations may be cited as the Local Government (Allowances and Expenses) (Scotland) Amendment (No. 2) Regulations 2010 and come into force on 6th April 2010.

Amendment of the Local Government (Allowances and Expenses) (Scotland) Regulations 2007

2.–(1) The Local Government (Allowances and Expenses) (Scotland) Regulations 2007(3) are amended as follows.

(2) After regulation 4(4) (reimbursement of expenditure incurred on approved duties) insert–

"(5) The reimbursement provided for in paragraph (fa) (costs of chartering a boat) of Schedule 2(4) is payable only to a member of Orkney Islands Council, Shetland Islands Council or Comhairle nan Eilean Siar carrying out any approved duties involving travel from one island to another within the same local authority area, where there is no direct public ferry service between those islands.".

(3) In regulation 5(5) (mileage allowances for travel)(5) after "area," insert "where there is no direct public ferry service between those islands,".

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations amend the Local Government (Allowances and Expenses) (Scotland) Regulations 2007 to clarify the circumstances in which the costs of chartering a boat may be claimed by local authority members. They also clarify the circumstances in which mileage allowances for travel by boat may be claimed by members.
