The Scottish Ministers make the following Regulations in exercise of the powers conferred by sections 3, 5, 6, 8 and 18(1) of the Whaling Industry (Regulation) Act 1934(1) and section 2(2) of the European Communities Act 1972(2) and all other powers enabling them to do so.

Citation, commencement and extent

1.-(1) These Regulations may be cited as the Sea Fishing (Miscellaneous Revocations) (Scotland) Regulations 2017 and come into force on 1st December 2017.

(2) These Regulations extend to Scotland only.

Revocations

2.  The Regulations listed in the schedule are revoked.

EXPLANATORY NOTE

(This note is not part of the Regulations)

These Regulations revoke 10 sets of Regulations. The Regulations relate to: ships in the whaling industry; improvement grants for agricultural, fishery and aquaculture products; requirements on fishing vessels to remain in port during particular periods; and payment of fisheries and aquaculture structures grants. All of the listed Regulations are now spent.

No Business and Regulatory Impact Assessment has been prepared in relation to these Regulations, as no impact upon business, charities or the voluntary bodies is foreseen.

1934 c.49. Section 3 was amended by the Sea Fish Industry Act 1938 (c.30) ("the 1938 Act"), section 43(a); and by the Fisheries Act 1981 (c.29) ("the 1981 Act"), section 35(3). Section 5 was amended by section 44 of the 1938 Act. Section 6 was amended by section 45 of the 1938 Act and section 35(4) and (5) of the 1981 Act. Section 8 was amended by section 35(6) of the 1981 Act. The functions of the Secretary of State, insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998 (c.46).

1972 c.68. Section 2(2) was amended by the Scotland Act 1998 (c.46) ("the 1998 Act"), schedule 8, paragraph 15(3) (which was amended by section 27(4) of the Legislative and Regulatory Reform Act 2006 (c.51) ("the 2006 Act")). Section 2(2) was also amended by section 27(1)(a) of the 2006 Act and by the European Union (Amendment) Act 2008 (c.7), schedule, Part 1. The functions conferred on the Minister of the Crown under section 2(2), insofar as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the 1998 Act. The revocations of S.I. 1991/777, S.I. 1992/130, S.I. 1992/670, S.I. 1995/1576 and S.I. 1998/1365 in the schedule of these Regulations are made under section 2(2) of the European Communities Act 1972.
