The Scottish Ministers make the following Regulations in exercise of the powers conferred by section 102(2) of the Heat Networks (Scotland) Act 2021(1).
1.—(1) These Regulations may be cited as the Heat Networks (Scotland) Act 2021 (Commencement No. 3) Regulations 2023 and come into force on 30 May 2023.
(2) In these Regulations “the Act” means the Heat Networks (Scotland) Act 2021.
2.—(1) The day appointed for the coming into force of the provisions of the Act specified in paragraph (2), insofar as not already in force, is 30 May 2023.
(2) The provisions are—
(a)section 46 (power to designate heat network zone),
(b)section 47 (duty on local authority to review heat network zoning in area),
(c)section 48 (designation of heat network zone by local authority),
(d)section 49 (designation of heat network zone by Scottish Ministers),
(e)section 50 (variation of heat network zone by local authority),
(f)section 51 (variation of heat network zone by Scottish Ministers),
(g)section 52 (two or more local authorities acting jointly in relation to heat network zone),
(h)section 53 (ministerial power of direction to designate or vary heat network zone),
(i)section 54 (guidance),
(j)section 63 (building assessment reports),
(k)section 65 (notification of building assessment reports),
(l)section 66 (guidance about building assessment reports),
(m)section 67 (interpretation of Part 5), and
(n)section 93 (heat networks delivery plan).

These Regulations bring sections 46, 47, 48, 49, 50, 51, 52, 53, 54, 63, 65, 66, 67 and 93 of the Heat Networks (Scotland) Act 2021 (“the Act”) fully into force on 30 May 2023.
The Bill for the Act received Royal Assent on 30 March 2021. Sections 97 to 103 came into force on the following day.

The following provisions of the Act have been brought into force by commencement regulations made before the date of these Regulations.
