ORDER PURSUANT TO RULE 39 OF THE
TRIBUNAL PROCEDURE (UPPER TRIBUNAL) RULES 2008 (AS AMENDED)
1. Having considered the material before it, and with the consent of the parties, the Upper Tribunal has decided that the First-tier Tribunal made an error of law as identified in the grant of permission read with the grounds of appeal and the respondent's Rule 24 Reply dated 12 January 2021.
Decision
2. The decision of the First-tier Tribunal is hereby set aside.
3. The appeal will now be remitted to the First-tier Tribunal for rehearing afresh, on a date to be fixed.
