­ Order Regarding Anonymity

 

Pursuant to rule 14 of the Tribunal Procedure (Upper Tribunal) Rules 2008, the appellant is granted anonymity. No-one shall publish or reveal any information, including the name or address of the appellant, likely to lead members of the public to identify the appellant. Failure to comply with this order could amount to a contempt of court .

 

 

DECISION AND REASONS

1.               This decision is made without a hearing pursuant to rule 34 of The Tribunal Procedure (Upper Tribunal) Rules 2008 ('the UT Procedure Rules').

2.               The appellant is a citizen of Ukraine. The appeal is due to be heard on 22 February 2023 to remake the decision in relation to a protection and human rights claim. The respondent offered to grant the appellant Humanitarian Protection status in July 2022, but a Consent Order was not agreed or finalised.

3.               Further to directions sent on 15 February 2023, the parties have confirmed in writing that they both agree to the appeal being determined without a hearing and for the appeal to be allowed solely on Humanitarian Protection grounds.

4.               Pursuant to rule 40(3) of the UT Procedure Rules it is not necessary for the Upper Tribunal to give detailed reasons save for issuing this order to give effect to the decision.

5.               The hearing listed on 22 February 2023 will be vacated.
