HIS HONOUR JUDGE BULL QC: In this matter we have received a letter sent by Fax today, 27 November 1994, explaining that the partner in the firm of solicitors dealing with this matter had:
"... overlooked the hearing set for this morning and failed to arrange for another Solicitor to deal with this matter in his absence."
In the circumstances, we will not of course penalise the Appellant in any way. We will order that this matter be relisted for a preliminary hearing. We make it plain, however, that we would expect on the adjourned hearing the attendance of someone from the firm of solicitors, who would no doubt explain why it was that this morning the case was unable to proceed.
