PRELIMINARY HEARING

JUDGE H WILSON: We have considered your arguments Mr Robinson and we have come to the conclusion that we should give leave for the matter to go forward for the full Tribunal to consider at a full hearing (1) the construction which should be placed on the absence of reference in the Disability Discrimination Act to associated companies for the purposes of computing exclusion and (2) whether the Employment Tribunal erred in law in refusing to lift the veil of incorporation as part of the evidence needed in order to come to a decision about numbers of employees.
We grant leave on those two grounds only and if needs be any other ground is dismissed.
