SIR CHRISTOPHER BELLAMY QC: The tribunal is satisfied that there are arguable points of law in this case regarding the construction of Regulations 10(8) and 11(1)(a) of the Transfer of Undertakings (Protection of Employment) Regulations 1981. It follows that this appeal should proceed to a full hearing, limited to the question whether the tribunal erred in law in construing those statutory provisions.

The case is to be listed for ½ a day, Category B. Skeleton arguments to be exchanged in the normal way in accordance with the Practice Directions.
