    APPEARANCES

    For the Appellant MR J N GALBRAITH-MARTEN
    (Of Counsel)
    Instructed by:
    Group Legal Services
    J Sainsbury Plc
    Stamford House
    Stamford Street
    London
    SE1 9LL

    JUDGE LEVY QC

  1. Having considered Mr Galbraith Marten's elegant oral and written submissions today, we are satisfied that the point raised in the Notice of Appeal should go forward to a full hearing. We think it would be helpful for Mr Galbraith-Marten at that hearing to elaborate further on the Skeleton Argument which we found helpful and specify any variation otherwise made to the Enhanced Company Severance pay, being that shown as nil in the box on page 2 of a letter of 15 September 1999, a copy which was produced to us for the purpose of this hearing. Category C, estimated time of Appeal – 2 hours.
