  1. This case has been put before me pursuant to the Practice instituted by the President. The Practice Direction was issued to the parties on 20 August 2003. The case was sifted by His Honour Judge Ansell on 1 September 2003 when standard directions were given for this case to be processed to a Preliminary Hearing. Notice of hearing was issued on 17 September. A reminder was issued on 1 October 2003, indicating that the Appellant should take the appropriate steps including the lodging of bundles in accordance with Judge Ansell's Order.
  2. On 10 October 2003 an Order was made indicating that unless the appropriate steps had been taken by 4.00pm on 14 October 2003 to lodge the appropriate documentation the Appellant would appear before a judge today.
  3. There has been no response to any of the communications which I have mentioned and the case having been called on this morning at 10.05am and there being no answer, I find that the Appellant is in breach of directions of a judge of the EAT and thus I exercise my power under Rule 26 to strike out the Notice of Appeal.
