Summary: The complainant requested copies of all correspondence relating to two incidents he believed occurred at a named school involving knifes and information relating to any further incidents that may have taken place. The Council responded informing the complainant that it was not obliged to confirm or deny if the information is held by virtue of section 40(5)(b)(i) of the Act. As he remained dissatisfied, the complainant approached the Commissioner. The Commissioner has investigated the case and is satisfied that the Council correctly applied section 40(5)(b)(i) of the Act.
