Summary: The complainant requested a copy of the public authority-s report into a fatal accident, and other information relating to the associated investigation. The public authority refused to provide the requested information on the grounds that it was exempt under section 30(1) of the Freedom of Information Act 2000 (the -Act-) and that the public interest in maintaining the exemption outweighed the public interest in disclosure. The Commissioner has investigated and concluded that the public authority correctly refused the requests on the basis that the information was exempt under section 30(1). He therefore requires no further steps to be taken in respect of this request. The Commissioner has, however, noted a number of procedural breaches of the Act.
