Summary: The complainant requested the Council to release the addresses of properties where the Council Tax payer had -˜gone away-™ owing Council Tax in excess of £1000 for the accounts period 2008/2009. The Council refused to disclose this information citing section 40(2) of the Act. The Commissioner has investigated the complaint and concluded that disclosure of the requested information would breach the Data Protection Act and therefore that the Council was correct to rely on section 40(2) of the Act.
