Summary: The complainant requested information from the Department of Health, Social Services and Public Safety (-DHSSPS-) regarding the Independent Review on Autism. The DHSSPS refused to disclose the requested information as it stated that it was exempt under section 41(1) of the Act. The Commissioner finds that the exemption in section 41(1) of the Act (information provided in confidence) is engaged in relation to part of the requested information. The Commissioner therefore requires the DHSSPS to disclose the remainder of the requested information which it holds. The Commissioner also finds that the DHSSPS has breached sections 1(1) and 10(1) of the Act.
