Summary: The complainant requested correspondence between HRH The Prince of Wales and Ministers at the public authority. The complainant also requested a list and schedule of the correspondence within the scope of his request. The public authority withheld the information on the basis of the exemptions at sections 37(1)(a) (communications with The Royal Household), 40(2) (personal data), and 41(1) (information provided in confidence). The Commissioner found that part of the information in the scope of the request was environmental and therefore caught by the Environmental Information Regulations 2004 (EIR). The public authority subsequently relied on the regulations at 12(5)(d) (confidentiality of proceedings), 12(5)(f) (interests of a person who provided information), and regulation 13 (personal data). This decision notice is currently under appeal to the Information Tribunal.
